1. Agreement to Terms

By accessing or using RankSafe ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

RankSafe provides an AI-powered SEO content generation and link building platform. The Service includes features for keyword research, content creation, internal linking, backlink management, analytics, and related SEO tools. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept all responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You may not use another person's account without permission. We reserve the right to refuse service, terminate accounts, or remove content in our sole discretion.

4. Subscription and Payment

RankSafe offers subscription-based pricing plans:

• Subscriptions are billed on a monthly or annual basis
• Payment is processed through Stripe, a third-party payment processor
• You authorize us to charge your payment method for all fees incurred
• Subscription fees are non-refundable except as required by law
• We reserve the right to change pricing with 30 days' notice
• Your subscription will automatically renew unless cancelled before the renewal date
• Free trials require a valid payment method and will convert to paid subscription unless cancelled

5. Cancellation and Termination

You may cancel your subscription at any time through your account settings. Upon cancellation:

• You will retain access to the Service until the end of your current billing period
• No refunds will be issued for partial billing periods
• Your data will be retained for 30 days after cancellation, then permanently deleted

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

6. Acceptable Use

You agree not to use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights of others
• Generate spam, malware, or harmful content
• Engage in fraudulent or deceptive practices
• Attempt to gain unauthorized access to the Service or related systems
• Reverse engineer, decompile, or disassemble the Service
• Use the Service to create competing products or services
• Generate content that violates third-party terms of service
• Exceed rate limits or usage quotas specified in your plan
• Resell or redistribute the Service without authorization

7. Content and Intellectual Property

Your Content: You retain all rights to content you create or upload to the Service ("Your Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process Your Content solely to provide and improve the Service.

AI-Generated Content: Content generated by our AI features is provided to you under a non-exclusive license. You are responsible for reviewing and ensuring all AI-generated content meets your standards and complies with applicable laws before publication.

Our Intellectual Property: The Service and its original content, features, and functionality are owned by RankSafe and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Third-Party Services

Our Service integrates with third-party services including AI providers (Claude API, OpenAI), SEO data providers (DataForSEO, SEMrush, Ahrefs), payment processors (Stripe), and others. Your use of these services is subject to their respective terms of service. We are not responsible for the availability, accuracy, or performance of third-party services.

9. Usage Limits and Fair Use

Your subscription plan includes specific usage limits:

• Article generation limits (1, 2, or 5 articles per day depending on plan)
• Keyword tracking limits (100, 500, or unlimited depending on plan)
• API rate limits and usage quotas

We reserve the right to enforce fair use policies and may throttle or suspend accounts that significantly exceed normal usage patterns or negatively impact Service performance for other users.

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect, use, and protect your data as described in the Privacy Policy. You are responsible for ensuring you have the right to use and process any data you upload to the Service, including compliance with data protection laws.

11. Warranties and Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. AI-GENERATED CONTENT IS PROVIDED WITHOUT WARRANTY OF ACCURACY, QUALITY, OR FITNESS FOR ANY PURPOSE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RANKSAFE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF YOUR DATA; (C) ANY INTERRUPTION OR CESSATION OF THE SERVICE; (D) ANY ERRORS OR OMISSIONS IN AI-GENERATED CONTENT. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless RankSafe and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; (d) content you generate, publish, or distribute using the Service.

14. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in San Francisco, California. You agree to waive your right to a jury trial and to participate in class action lawsuits.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be replaced with a valid provision that most closely matches the intent of the original provision.
